Terms of Service

Effective: April 16, 2026

Welcome to Mahi Pasha Event Design (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website at mahipasha.com and any services, content, or products offered through it (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Accounts

  • You are responsible for maintaining the confidentiality of your password and for all activity under your account.
  • You agree to provide accurate and current account information.
  • You must verify your email address before signing in for the first time.
  • We may suspend or terminate accounts that violate these Terms, are inactive for extended periods, or appear fraudulent.
  • You may delete your account at any time by contacting mahi@mahipasha.com. Order records may be retained for tax and accounting compliance — see our Privacy Policy.

3. Orders, pricing, and payment

  • All prices are in US dollars (USD) and exclude applicable taxes and shipping charges, which are calculated at checkout.
  • We reserve the right to correct pricing errors or refuse orders, even after an order has been confirmed. In such cases we will notify you and issue a full refund if payment was collected.
  • Placing an order constitutes an offer to purchase. Our confirmation email constitutes our acceptance of that offer.
  • Payment is processed by Stripe. By submitting payment information you authorize Stripe to charge the payment method you provided.
  • Sales tax is calculated based on your shipping destination as required by law.

4. Shipping

Shipping rates, methods, and estimated delivery times are described in our Shipping Policy. Title and risk of loss pass to you upon delivery to the carrier.

5. Returns and refunds

Our Return & Refund Policy is incorporated by reference into these Terms. Certain items (custom, personalized, and made-to-order goods) are non-returnable.

6. Intellectual property

All content on the Service — including text, graphics, logos, photographs, images, product designs, and software — is owned by Mahi Pasha Event Design or its licensors and is protected by US and international copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written consent.

7. User-generated content

If you post comments, reviews, or other content through the Service (“User Content”):

  • You retain ownership of your User Content.
  • You grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, and display your User Content in connection with the Service.
  • You represent that you own or have the right to submit the User Content and that it does not infringe any third-party rights.
  • We reserve the right (but have no obligation) to review, moderate, or remove User Content at our discretion.

8. Prohibited uses

You agree not to:

  • Use the Service in violation of any applicable law or regulation
  • Upload viruses, malware, or other malicious code
  • Interfere with the security or integrity of the Service
  • Attempt to gain unauthorized access to any accounts, systems, or data
  • Scrape, spider, or otherwise extract data by automated means without our written permission
  • Impersonate any person or entity
  • Harass, threaten, or abuse other users or our staff
  • Post content that is illegal, defamatory, obscene, or infringes any rights
  • Use the Service to send unsolicited commercial messages

9. Copyright / DMCA notices

If you believe content on our Service infringes your copyright, send a notice to mahi@mahipasha.com with:

  • Identification of the copyrighted work
  • The URL or location of the infringing material
  • Your contact information
  • A statement that you have a good-faith belief that the use is not authorized
  • A statement under penalty of perjury that the information is accurate and that you are authorized to act
  • Your physical or electronic signature

10. Third-party services

The Service integrates with third-party services (Stripe for payments, email providers, shipping carriers). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Product images are representative; actual colors and textures may vary slightly due to screen calibration, lighting, and natural variation in handmade or hand-finished items.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MAHI PASHA EVENT DESIGN, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS (USD $100), WHICHEVER IS GREATER.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for consequential damages, so the above may not fully apply to you. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Mahi Pasha Event Design, its owners, employees, and agents from any claim, damages, liability, cost, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. Dispute resolution

Informal resolution first

Before filing a claim, you agree to try to resolve the dispute informally by contacting mahi@mahipasha.com. We will attempt to resolve the dispute within 60 days of your notice.

Small-claims court

You may bring an individual action in small-claims court in Orange County, California if it qualifies.

Binding arbitration

Otherwise, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Orange County, California. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.

Class-action waiver

YOU AND WE AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. If a court finds this waiver unenforceable, then this entire section 15 is null and void, and the dispute will proceed in court.

Opt-out

You may opt out of binding arbitration and the class-action waiver within 30 days of first accepting these Terms by emailing mahi@mahipasha.com with “Arbitration Opt-Out” in the subject line. Your opt-out will not affect any other provision of these Terms.

16. Changes to these Terms

We may update these Terms from time to time. The “Effective” date indicates when they were last revised. Material changes will be announced on our website or by email. Your continued use of the Service after an update constitutes acceptance of the revised Terms.

17. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and us.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
  • No waiver: Our failure to enforce any right under these Terms is not a waiver of that right.
  • Assignment: You may not assign these Terms without our written consent. We may assign them without notice as part of a sale, merger, or reorganization.
  • Force majeure: We are not liable for delays or failures due to events beyond our reasonable control (natural disasters, labor disputes, carrier failures, government actions, etc.).
